These Terms & Conditions ("Terms") govern your use of Lensqivo, available at lensqivo.com, including the photographer dashboard and the photographers' websites we host. By creating an account or using the service, you agree to these Terms and to our Privacy Policy (lensqivo.com/privacy).
Lensqivo is operated by [legal name as in the commercial registration], commercial registration no. [number], [address], Kingdom of Saudi Arabia ("we", "us"). Contact: [lensqivo.support@gmail.com] · [phone].
1. The service
Lensqivo lets photographers ("you") create a portfolio website, publish albums, share private galleries with clients, receive messages and reviews, show photography packages, and manage clients, bookings, contracts and appointments. Features and limits depend on your plan.
2. Your account
- You must be at least 18 years old and provide accurate information, including a Saudi mobile number, and keep it up to date.
- You are responsible for keeping your password safe and for everything done through your account. We recommend turning on two-step verification.
- Tell us right away if you believe someone has accessed your account without permission.
3. Plans, trials and payment
- Plans, prices and limits are shown on our website and in your dashboard. Prices are in Saudi Riyal (SAR).
- New accounts may start with a free trial. No payment card is needed for the trial.
- Online payments are processed by MyFatoorah. We never receive your card details.
- Renewals add a new period on top of the time you have left. A plan change starts once it is paid, and unused time is carried over.
- A coupon discounts one payment only, can be used once per account, and may have an expiry date or other conditions.
- When a trial or paid period ends without payment, your website stays online for a short grace period, then it goes offline until you renew. Your content is kept, but you cannot add new content.
- If you move to a smaller plan, content above the new limits stays in your account but some of it may no longer be shown on your website (for example, packages above the limit).
- We may change prices, plans, limits and features. A new price applies from your next renewal or plan change, never to a period you have already paid for. We will tell you about price increases before they apply.
- Payments are non-refundable except where Saudi law requires otherwise. This includes accounts suspended or closed for breaking these Terms.
4. Your content
- You keep all rights to the photos, text and other content you upload ("Your Content").
- You give us a limited licence to store, copy, resize, watermark, translate, display and deliver Your Content only as needed to run the service for you, including showing your website in the photographer directory if you keep that option on.
- You confirm that you own Your Content or have permission to use it, and that it does not infringe anyone's rights or break any law.
- You must have the consent of the people you photograph before publishing their photos, and a parent's or guardian's consent for children. Use private albums for photos that are not meant for the public.
- The details you show on your website, such as prices, packages and licences, must be accurate and up to date. Licences are shown as you enter them; we do not verify them.
5. Your website and your clients
- You alone are responsible for your website and everything you or your clients enter in your account, including photos, texts, prices, packages, licences, contracts, bookings and client records. We do not review this content before it is published.
- You alone are responsible for your work and your dealings with your clients: your services, prices, bookings, deliveries, payments, refunds, contracts and any dispute with a client. We are not a party to any agreement between you and your clients, and we do not guarantee your work or your clients' payments.
- The booking, payment and contract tools only help you keep your own records. Payments your clients make to you are not processed or held by us.
- You must hold any licence or registration your work requires (for example a freelance document or commercial registration) and follow the laws that apply to it.
6. Your clients' data (data processing)
When you store data about your clients in Lensqivo (client list, bookings, payments, contracts, appointments, messages, private albums), you are the controller of that data under the Saudi Personal Data Protection Law, and we process it on your behalf. For this data:
- You confirm you have a lawful basis to collect it, that you tell your clients how you use it, and that you answer their requests about their data.
- We process it only to provide the service to you, keep it confidential, and protect it with the measures described in our Privacy Policy.
- We use the providers listed in our Privacy Policy, under contracts that protect the data, and update that list when it changes.
- Our team accesses your account only to give you support, keep the service safe, or when required by law; every such access is logged.
- We will tell you without undue delay if a breach affects your clients' data, and help you meet your legal obligations.
- When your account is permanently deleted, this data is deleted with it, and removed from backups within 5 weeks.
7. Reviews, messages and the directory
- Visitors can leave reviews and send messages on your website. Reviews are published straight away. You cannot edit or delete them, but you can report a review to us; we decide whether to keep or remove it, and we may remove reviews that are abusive, false or spam at any time.
- Reviews and messages are written by visitors, not by us. We are not responsible for what they say, and we do not guarantee that they are accurate.
- Your website is listed in the public photographer directory while you have an active plan and at least one public album; you can turn this off in your website settings. We decide how the directory is ordered and filtered, and we do not guarantee any number of visitors or clients.
8. Contracts tool
The contract templates are examples to help you start. They are not legal advice. You are responsible for the content of your contracts and for checking they suit your work and Saudi law.
9. Acceptable use
You must not use Lensqivo to:
- publish content that is illegal, offensive, obscene, or that violates the laws and regulations of the Kingdom of Saudi Arabia;
- infringe copyright, trademarks or privacy, or publish photos of people without their consent;
- mislead visitors, send spam, or collect visitors' data without permission;
- attempt to access other accounts, disrupt the service, or bypass plan limits or security measures.
We may remove content, or suspend or close accounts, that break these rules. Where possible we will tell you why first.
10. Website addresses and custom domains
- Your free address (yourname.lensqivo.com) is yours while your account is active. You can change it once every 30 days; the old address redirects to the new one for 30 days and may then become available to others.
- If your plan allows it and you connect your own domain, you remain responsible for its registration, renewal and DNS settings.
11. Availability, backups and other services
- We work to keep the service available and back up data regularly, but we do not guarantee uninterrupted or error-free service. We may pause the service briefly for maintenance. Keep your own copies of your original photos.
- Some features depend on services run by others, such as Google Drive, MyFatoorah, email delivery and your domain provider. We are not responsible for their outages, changes or decisions, and a feature may stop working if such a service changes or ends.
- We are not responsible for delays or failures caused by events outside our reasonable control, such as outages of our hosting or internet providers, cyber attacks, natural disasters or decisions of authorities.
12. Closing your account
You can delete your account from your dashboard. Your website goes offline immediately and your account can be restored within 30 days; after that, your account and all Your Content are permanently deleted. We may suspend or close accounts that break these Terms.
13. Liability and indemnity
- To the extent permitted by law, Lensqivo is not liable for indirect or consequential losses, lost profits, lost clients, or loss of data. Our total liability is limited to the amount you paid us in the three months before the claim.
- You agree to compensate us for any claim, loss or cost (including reasonable legal fees) that arises from Your Content, your website, your dealings with your clients, or your breaking these Terms or the law.
14. Changes to these Terms
We may update these Terms. We will tell you about important changes by email or in your dashboard before they apply. Continuing to use the service after that means you accept them.
15. Governing law and language
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Disputes are subject to the jurisdiction of the competent courts in [city]. These Terms are available in Arabic and English; if they differ, the Arabic version prevails.
